1. Introduction
Welcome to Find Your SEO (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of findyourseo.com (the “Site”), including any content, functionality, and services offered on or through the Site.
Find Your SEO is a technical SEO and local search consultancy headquartered in Pine Bluff, Arkansas, serving businesses across the Natural State and beyond.
By using the Site, you accept and agree to be bound by these Terms and our Privacy Policy, incorporated herein by reference. If you do not agree, you must not access or use the Site.
2. Changes to the Terms
We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them and apply to all access to and use of the Site thereafter. Your continued use of the Site following the posting of revised Terms means you accept and agree to the changes. All service engagements require a signed agreement or written confirmation outlining scope, deliverables, timeline, and fees. Invoices are payable according to the terms in the project agreement (typically Net 15 or Net 30). Late payments may incur a service fee and/or interest charges. Services may be paused or terminated for non-payment.
Local SEO retainers, technical audits, citation building, and all other services are billed as agreed in the applicable statement of work. We do not guarantee specific rankings, traffic, or revenue results unless explicitly stated in a signed contract. SEO outcomes depend on competitive landscapes, search engine algorithm changes, and third-party platform policies beyond our control.
5. Free Audit Terms
When you request a free website audit through our Site, you grant us permission to analyze your website for SEO purposes. The audit is provided as-is for informational purposes and does not create a client-service relationship. We may use the information you provide (name, email, website URL) to follow up regarding our services.
6. Intellectual Property
The Site and its original content, features, and functionality are owned by Find Your SEO and are protected by international copyright and trademark laws. You may not use any content on the Site for any commercial purpose without our express written consent.
All materials we create in the course of providing services—including but not limited to SEO strategies, audit reports, citation lists, content recommendations, and technical implementations—remain our intellectual property until full payment is received. Upon full payment, deliverables are transferred to you for your internal business use. You may not resell, redistribute, or claim authorship of our work without written consent.
7. Client Responsibilities
You agree to provide timely information, website access, and approvals necessary for us to deliver services. You warrant that any material provided to us does not infringe on the rights of any third party. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
8. Third-Party Links and Tools
The Site may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
We may use third-party tools and platforms in delivering our services (e.g., Google Search Console, Google Business Profile, SEMrush, Ahrefs, analytics platforms, scheduling tools). We are not responsible for downtime, data loss, or changes in policies of these third-party platforms.
9. Confidentiality
Both parties agree to maintain the confidentiality of proprietary information shared during the course of any engagement, including business plans, technical data, website access credentials, and marketing strategies. This obligation survives termination of any service agreement.
10. Limitation of Liability
To the maximum extent permitted by law, Find Your SEO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, or business opportunity, arising out of or in connection with your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these Terms or our services shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
11. Disclaimer of Warranties
The Site and all services are provided “as is” and “as available” without any warranties, express or implied. We do not guarantee that the Site will be uninterrupted, secure, or error-free. We do not guarantee any specific search engine rankings, traffic levels, or return on investment unless explicitly stated in a signed contract.
12. Indemnification
You agree to defend, indemnify, and hold harmless Find Your SEO, its affiliates, and its and their respective officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Site.
13. Termination
Either party may terminate a service agreement with 14 days’ written notice. Upon termination, you are responsible for all work completed and expenses incurred up to the termination date. No refunds are provided for work already delivered or retainers already earned.
We reserve the right to suspend or terminate your access to the Site or our services immediately without notice if you violate these Terms.
14. Governing Law
These Terms and any dispute arising out of or in connection with them or the Site shall be governed by and construed in accordance with the laws of the State of Arkansas, United States, without giving effect to any principles of conflicts of law.
15. Dispute Resolution
Any dispute arising out of or in connection with these Terms or the Site shall first be resolved through good-faith negotiations. If the parties are unable to resolve the dispute through negotiations, the parties agree to submit the dispute to mediation in accordance with the rules of the American Arbitration Association. The mediation shall be held in Jefferson County, Arkansas. If mediation fails, the dispute shall be resolved exclusively in the state or federal courts located in Jefferson County, Arkansas.
16. Severability
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Find Your SEO regarding your use of the Site and supersede all prior agreements and understandings.
